4. User Responsibilities

 

You agree to:

 

  • Use our platform lawfully and professionally

  • Keep login details confidential

  • Ensure your use complies with all relevant policies and regulations

  • Not reverse engineer, copy, resell, or exploit the platform in any unauthorised way

 

We reserve the right to suspend or terminate your account if these Terms are breached.

5. Payment Terms

 

Access to our platform is subject to the payment terms outlined in your contract or agreement. Unless otherwise stated:

 

  • Fees are billed in advance and are non-refundable

  • Payment must be made within the timeframe stated on the invoice (typically 14 or 30 days)

  • Late payments may result in restricted access and additional charges

 

If payment is made via invoice, you are responsible for ensuring your organisation processes payment on time.

 

6. Refund Policy

 

Due to the digital nature of our services, all sales are final unless otherwise agreed in writing. Refunds will not be issued for unused services or early cancellations unless there is a fault on our part.

 

7. Intellectual Property

 

All content, branding, code, and design on our website and platform are the property of Elevate Training or our licensors. You may not reproduce, distribute, or create derivative works without express written permission.

 

If you upload any training materials or content, you:

 

  • Retain ownership of your content

  • Grant Elevate Training a licence to use, host, display, and distribute it solely for the delivery of services

 

You must not upload unlawful, offensive, or infringing material.

8. Data Protection & Privacy

 

We are committed to data protection. All personal data is processed in line with the UK GDPR and our Privacy Policy.

 

We act as a data controller for client information and as a data processor where training records are managed for your organisation.

 

By using our services, you agree to our collection, use, and storage of data as outlined in our Privacy Policy.

10. Availability & Support

 

We strive to provide at least 99% uptime across our LMS platform. Occasional maintenance or upgrades may occur. Support is available via email and response times are usually within 1–2 working days.

 

Elevate Training is not liable for downtime caused by third-party services or factors outside our control.

11. Limitation of Liability

 

To the fullest extent permitted by law:

 

  • We shall not be liable for any indirect, incidental, or consequential losses

  • Our total liability shall not exceed the total fees paid by you in the 12 months prior to the event giving rise to the claim

 

Nothing in these Terms excludes liability for death, personal injury, or fraud.

 

12. Termination

 

We reserve the right to terminate or suspend your access at any time if you breach these Terms. You may cancel your service by providing written notice in accordance with your contract.

13. Changes to These Terms

 

We may update these Terms occasionally. If we do, we will post the new version on this page and notify users via email or banner where appropriate. Continued use after changes means you accept the new Terms.

 

14. Governing Law

 

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England.
